Creator litigation before the Frankfurt Higher Regional Court

LTO identifies Dr. Nik Sarafi as counsel for the defendant streamer in case 16 U 80/24. According to the court's press release, freedom of expression under Article 5(1) of the German Basic Law was balanced against personality rights: some statements remained permissible, while others were prohibited. The competition law claims were unsuccessful in this case.

No A negative review is not unlawful simply because of its content. For example, actual contact, verifiable allegations, the context and the limits of admissible expression of opinion are decisive.

How quickly does a complained content disappear?

It depends on the facts, the reaction of the other party and the chosen procedure. Deletion or a specific point in time cannot be guaranteed.
