DR. SARAFI lawyers successfully enforce personal rights for streamers

Hamburg, March 19, 2025 — A streamer deliberately published an out-of-context message from our client from a private chat. The deliberate omission of the essential context resulted in a misleading presentation. DR. SARAFI Rechtsanwälte enforced a declaration of injunctive relief out of court and achieved the removal of the defamatory contribution.
Background to the proceedings
Our client, a well-known streamer, has already successfully fought back against another public figure. Now another streamer tried to defame him again and attach a political sentiment that is completely alien to our client.
The other side deliberately published a message from our client taken out of context from a private chat. The deliberate omission of the essential context resulted in a misleading presentation which could lead readers to misinterpret. As a result, our client was subordinated to a position that he had never represented at any time.
Legal classification
The deliberate distortion of a statement by omitting relevant contexts may constitute a serious violation of personal rights under Art. 2 para. 1, Art. 1 para. 1 GG.
Nobody has to accept that their own statements are falsified or manipulatively taken out of context in order to gain a different — often disadvantageous — meaning. Such distortion not only violates general personal rights, but can also constitute slander or defamation.
The success of our legal action
After the defamatory allegation became known, we took action out of court against the person responsible:
- Warning: We asked the other party to remove the misleading post immediately.
- Declaration of cease and desist: After his own examination, the opponent acknowledged his infringement and signed a declaration of injunctive relief. In doing so, he undertook not to repeat the misstatement in future.
This quick and effective enforcement meant that the misleading contribution was removed and our client was able to avert further damage.
Practical relevance and recommendations for streamers and content creators
In the online world, defamatory statements among streamers, YouTubers, or other public figures are often seen and accepted as “part of the business.” But this is a fallacy.
Mere counterspeech — i.e. public denial of false allegations — is often not enough, as it simply creates a “statement-against-statement” situation. The public is then often left in the dark as to who is actually telling the truth.
On the other hand, a declaration of injunctive relief enforced out of court or in court may have a high evidentiary value. It objectively shows that the disputed statement was unlawful and had to be removed. This not only helps to create a counter-public sphere, but also protects the reputation of the person concerned.
Especially for streamers and influencers who depend on advertising partnerships and TV engagements, an incorrect public presentation can have serious economic consequences. Defending one's own personal rights is therefore essential.

This case shows once again that it is worthwhile to take action against false or distorting representations. The manipulation of statements by omitting relevant contexts can constitute an unlawful violation of personality and can be successfully prevented.
