Flight cancelled: can the airline charge extra for a later travel date?

After a cancellation, you want to travel several months later. When rebooking without a surcharge is possible, and why available seats, comparable conditions and your previous choice matter.

Refund, earliest re-routing or a later date of your choice

Following cancellation, Article 8(1) of Regulation (EC) No 261/2004 provides different options: reimbursement subject to the statutory conditions, re-routing at the earliest opportunity, or later re-routing at your convenience. The airline must provide the information needed to make an informed choice (CJEU, paragraphs 43 to 46).

Our recommendation: if you still want to fly, clearly request re-routing. Do not rush to select “refund” simply because the booking portal prominently displays that option. Any statements already made and payments received need to be considered when assessing a subsequent request to rebook.

Why a much later flight may qualify

The CJEU case concerned flights booked in 2020 from Frankfurt via Doha to Denpasar and back, which were subsequently cancelled. In August 2022, the passengers requested travel in October and November 2022. The Court clarified that Article 8(1)(c) does not require a temporal link with the cancelled flight. The national court still had to determine the individual claim for damages (paragraphs 9 to 14, 47 and 53 to 65).

As supplementary authority, the Federal Court of Justice held on 27 June 2023 in X ZR 50/22 that the rebooking owed must not depend on an additional payment. Higher prices during the new travel period do not remove that right. This was an injunction case brought by a consumer association, not a blanket payment award to all passengers (Federal Court of Justice, paragraphs 16 to 20, 40 and 48 to 54).

Available seats and comparable conditions still matter

First, the Regulation must apply to the flight in question. It generally covers departures from the EU. Flights from a third country to the EU are subject to further conditions, particularly operation by an EU air carrier and the question of benefits already received in the third country. The booking and fare also need to be checked (Article 3).

The choice concerns transport to the original final destination under comparable conditions. It does not establish a blanket entitlement to a different holiday destination or a requested upgrade. Available seats are expressly required. If you simply change your plans while the booked flight operates, you cannot rely on the cancellation rights discussed here.

Our hypothetical example: an airline cancels a Frankfurt to Madrid flight. The passenger wants to fly to Madrid three months later in the same travel class. If the requirements are met and seats are available, “your old ticket was cheaper” is not enough to justify a surcharge. The example assumes that reimbursement has not already been conclusively chosen.

Assess re-routing and additional monetary claims separately

Extraordinary circumstances may exclude standard compensation. They do not, for that reason alone, remove the assistance required by Article 8. The CJEU expressly distinguishes these obligations (paragraphs 48 and 49). Re-routing without an extra charge therefore neither automatically creates nor rules out an additional monetary claim.

If you book a replacement flight yourself after a refusal, reimbursement requires a separate assessment. The CJEU limits compensation for failures to provide assistance to what is necessary, appropriate and reasonable in the individual circumstances (paragraphs 50 and 51). The judgment does not authorise passing on any ticket price you choose.

How to prepare your rebooking request

Give the operating airline your booking reference, the cancelled flight and the desired new date. Explicitly request re-routing without a surcharge under comparable conditions. The following documents help assess your case; they do not replace the airline’s duty to provide information.

  • Keep your booking confirmation, original travel dates and cancellation notice.
  • Record the desired connection, travel class and visible seat offers, including the date.
  • Keep the surcharge demand, refusal and previous correspondence.
  • Provide full details of any refunds, vouchers or rebookings already selected.

No unlimited deadline and no premature application of new rules

The absence of a required temporal link does not mean claims remain open indefinitely. For time limits on court proceedings, the CJEU refers to national law and the EU requirements governing its effectiveness (paragraphs 60 to 63). Have the deadlines checked against the specific sequence of events.

This article reflects the legal position on 2 November 2026. Under Article 3, the already published amending Regulation (EU) 2026/2202 applies from 23 October 2027. Its future rules are not presented here as conditions already governing these claims.
