Dr. SARAFI successfully takes action against Google

Our client — a renowned dental and orthodontic practice — received a Google rating that was not from a patient, but (presumably) from a competitor or from another unknown person with intent to harm.
We appealed to Google out of court and asked Google to delete this review. Google responded late to our letter and held us back. We asked Google to permanently delete the review and threatened to take legal action against Google if the deadline expired, but Google maintained the review and allowed our deadline to pass.
Finally, as announced, we filed for a preliminary injunction against Google at the Darmstadt Regional Court.
After the case was pending before the court, the disputed assessment disappeared.
Google must pay all court and attorney fees. The Google lawyers tried to “correct” the amount in dispute downwards, namely to 3,000€, in the hope of also reducing the amount of costs to be borne. However, the court did not follow this, as we were able to show that a higher amount in dispute was appropriate, based on the specific statement complained of.
