What does the research include? The chosen time budget includes AI-based similarity research and legal evaluation. AI helps to structure search variants and results. The legal evaluation is carried out by a lawyer.
More time enables an in-depth search and evaluation. Which scope makes sense depends on the sign, the goods and services and the market. Even a search guarantees neither registration nor freedom of conflict. Rights outside the investigated registers and applications that have not yet been published may play a role.
Without additional hours booked, the order does not include any similarity research. Additional expenses beyond the selected budget will only be calculated by separate agreement.

Preparation and electronic filing of an individual trade mark in the expressly selected territory: an EU trade mark at the EUIPO by default, or a German trade mark at the DPMA. The fixed legal fee covers up to three classes, including agreement on the list of goods and services. Before filing, we review the selected number of classes against your business model; any changes, including additional costs, are agreed with you in advance. Filing takes place only after your approval. An optional similarity search costs EUR 500.00 net (EUR 595.00 including 19% VAT) per hour. The selected search budget covers AI-assisted similarity research and assessment by an attorney for the selected territory; no similarity search is included unless additional hours are booked. AI supports the research; an attorney performs the legal assessment. Registration and freedom from conflicts are not guaranteed. Oppositions, disputes, more than three classes and international registrations beyond the EU are not included and require a separate instruction.
Official fees are payable separately in addition to the legal fee: electronic EUIPO filing costs €850 for one class, €900 for two classes and €1,050 for three classes; each further class costs €150. Electronic DPMA filing costs €290 for up to three classes; each further class costs €100. Additional classes also require a separately agreed legal fee. Official fees are not collected with this payment. Payment arrangements and due dates will be communicated before filing. Official fees are generally not refundable merely because an application is unsuccessful.
By placing the order, you make a binding offer for the instruction described and pay the fee in advance. The automated payment confirmation does not constitute acceptance of the engagement. We check, in particular, conflicts of interest and the scope of services, and confirm acceptance separately by email. If we cannot accept the instruction, we refund the advance payment in full. No substantive work or deadline monitoring takes place before acceptance. If an accepted instruction is subsequently terminated or the file cannot be accessed, we charge for work performed in accordance with the statutory rules and the agreement, and refund any remaining advance payment. Additional chargeable services require a separate agreement.

The stated fixed fee, including 19% VAT, is agreed for the limited instruction described. This fee may differ from the statutory fee under the German Lawyers’ Remuneration Act (RVG). Where costs are reimbursed, the opposing party, another party to the proceedings or the state treasury is generally not required to reimburse more than the statutory fee. You bear any fees exceeding that amount. This agreement is not a power of attorney. The case-file access package does not include advice or analysis; these services require a separate instruction and a separate fee arrangement.

Withdrawal policy and sample form Withdrawal information for consumers: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date the contract is concluded. To exercise this right, you must inform us, DR. SARAFI Rechtsanwaltsgesellschaft mbH, Leerbachstraße 54, 60322 Frankfurt am Main, info@sarafi.de, of your decision by an unequivocal statement (for example a letter or email). You may use the model form below, but it is not mandatory. To meet the deadline, it is sufficient to send your notice before the withdrawal period expires. If you withdraw, we will reimburse payments received without undue delay and no later than fourteen days after receiving your notice. We will use the same payment method unless expressly agreed otherwise; you will not incur any fees. If you requested that services begin during the withdrawal period, you must pay a proportionate amount for the services already provided compared with the full scope of the contract. On full performance, the right of withdrawal expires only if you previously expressly agreed to an early start and acknowledged that the right would expire.
