The package only includes the application for file inspection and the permitted digital provision of up to 100 pages. The substantive or legal examination of the file, analysis, advice, opinion, defense or monitoring of procedural time limits is not included. You must order and pay for such services separately.
More than 100 pages or an additional order will be agreed separately before additional paid processing. We calculate administrative costs based on actual expenses incurred. In the case of purely electronic management and transmission of a fine file, the shipping fee in accordance with Section 107 (5) OWiG does not apply.
The file as a starting point.
For accused persons in criminal proceedings and victims of administrative fines, we first clarify representation, file number and competent authority. After an agreed acceptance of the mandate, we request inspection and coordinate the permitted digital provision with you.
Fees and expenses.
The flat fee is 99€ including sales tax for the agreed collection of documents and digital provision of up to 100 pages. It is set out in a separate remuneration agreement. Actual administrative costs are added; €12 is not an automatic fee for every order.
Assign procedures.
The file number, competent authority, your procedural role and known deadlines are required. We will personally clarify the power of attorney and the means of transmission. Please do not send sensitive files by e-mail without being asked.
Is legal advice included in the package?
No The mere procurement of documents does not constitute substantive advice in accordance with § 34 RVG. A legal audit or advice requires a separate mandate and a separate fee agreement. In particular, the file inspection package does not include an analysis of the chances of success or recommendation for action.
Is 100 pages a legal limit?
No A number of pages can limit the size of an agreed package. It is not a general legal limit for file inspection or shipping charges.
Is access to the file guaranteed?
No The competent authority shall decide on the grant and scope. Restrictions and procedural delays are possible. We handle such cases on behalf of us.
Does the request for access to the file meet my deadlines?
No A file request or mandate request does not impede an appeal or appeal period. Notify known deadlines immediately and clarify whether the deadline has been expressly accepted.
Can I share the file I received?
Not unconditionally. According to Section 32f (5) StPO, the documents provided as part of the file inspection may neither be disseminated publicly in whole or in part nor made available to third parties for purposes that are not procedural. Personal data obtained is generally subject to the purpose of viewing the file. In addition, publications may be punishable under § 353d StGB. Please therefore clarify an intended transfer with us in advance.
When can publishing file content be punishable?
Section 353d No. 3 StGB prohibits publicly disclosing the text of the indictment or other official documents of criminal, fine or disciplinary proceedings in full or in significant parts before they have been discussed in public hearing or the proceedings have been completed. There is a risk of imprisonment of up to one year or a fine. Section 353d No. 1 and 2 StGB also include violations of certain legal communication bans and court-imposed confidentiality obligations. Other distribution and publication restrictions may persist even after public discussion or conclusion of proceedings.
